Ro’s Round Robins Release and Waiver of Liability for Negligence, Assumption of Risk, Indemnity and Save Harmless Agreement

1. ACKNOWLEDGEMENT, agree and represent that I understand the nature of such activities and I am the opinion that I qualified, in good health, and in proper physical condition to participate in such activity. I further agree and warrant that if any time I believe that my health and physical condition should change so that it would be unsafe for me to participate in such activity, I will immediate discontinue from further participation in such activity.
2. I FULLY UNDERSTAND THAT: (a) my participation in the aforesaid activities involve risk and danger of serious bodily injury, including permanent disability, paralysis, and death (“risk”); (b) these risks and dangers maybe caused by actions or inactions, the actions or inactions of other participating in the activity, the condition in which the activity take place, or the negligence of Ro’s Round Robins, LLC;(c) there may be risks and social economic losses either known or not known to me or not readily foreseeable at this time, and I fully accept and assume all such risks and responsibilities for losses, costs and damages which I may incur as a result of my participation in the activity.
3. I HEREBBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Ro’s Round Robins, LLC or , their respective administrators, director, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and owners and lessor premises on which the activity takes place, (each considered on of the “RELEASEES” herein) from liability, claims demands, loses, damages on my account caused or alleged to be caused in whole  or in part by negligence of the Releasees and Waiver of liability, Assumption of Risk and Indemnify Agreement, I will indemnify, save and hold harmless each of the Releasees,  from any litigation expenses, attorney’ fees, loses, liability, damage or costs of which they may incur as a result of such claim.
4. I FULLY UNDERSTAND THAT: (A) I am registering for an agreed upon level of round robins and agree that I am capable of playing on that level and that Ro’s Round Robins, LLC is not responsible if opponent is not matched to my level.  I understand that levels will vary in range and I will assume full responsibility to end a match if at anytime that I feel another player(s) are not matched on according to my level either as an opponent or as a partner. I understand that I have the right to end a match at anytime that I feel I am in danger of injury. (b)  Ro’s Round Robins, LLC is not financially responsible for loses in time that may occur due to me ending a match or not attending. (c) I will NOT SUE Ro’s Round Robins for any injuries that may occur due to other tennis player’s abilities as a partner or opponent’s injury including permanent disability, paralysis, and death (“risk”).

 

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITH OUT INDUCEMENT AND INTEND OT TO BE A COMPLETE AND UNCONDITONAL, RELEASE OF ALL LIABLITLIY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOT WITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

This agreement will remain in full force and effect at all times.
